Terms of Service

These terms govern your use of Thriving Kids (thrivingkids.com), an independent platform operated from Australia that connects families with independent support providers for children and young people in Australia and the United States. By creating an account, submitting an enquiry, or listing your services, you agree to these terms, our Privacy Policy (or US Privacy Policy if you're in the United States) and our Disclaimer.
1. What Thriving Kids is (and isn't)
Thriving Kids is a matching and directory platform. We are not a healthcare provider, allied health service, or government agency, and we do not deliver clinical care, therapy, assessment, diagnosis, or treatment. Providers listed on the platform are independent businesses or practitioners β not our employees, agents, or partners. Any engagement, agreement, payment for services, scheduling, or clinical relationship is directly between the family and the provider.
2. Accounts
You must provide accurate information and keep your login details secure. You're responsible for activity under your account. You must be at least 18 to create an account. We may suspend or close accounts that breach these terms, misuse the platform, or pose a risk to other users.
3. For families
- The platform is free for families.
- Matches are suggestions based on the location and needs you tell us about β they are not clinical recommendations or endorsements. You choose who to contact and engage; always satisfy yourself that a provider is suitable for your child.
- When you choose to connect with a provider, we share your enquiry details (including contact details) with that provider so they can respond.
- Information you submit must be accurate and about your own child or a child you have parental responsibility for.
4. For providers
- You must hold, and keep current, all registrations, licenses, checks and insurance required to deliver your services in your jurisdiction β and everything you declare or submit to us must be accurate and about you.
- Australia: credentials you declare (professional registration, Working with Children Check, insurance, NDIS registration) may be reviewed before or after your listing goes live.
- United States: your professional license is verified against state licensing board records at application and periodically re-checked. If your license lapses, is suspended, or is subject to board action, we may suspend or remove your listing immediately.
- Your listing content must be accurate, must not be misleading, and must not include claims you cannot substantiate. We may edit, decline, or remove listings at our discretion.
- Family enquiry details shared with you are confidential β use them only to respond to that family about the support they requested, never for unrelated marketing, and never share or sell them.
5. Subscriptions, billing & refunds
- Provider listings are paid subscriptions (billed in AUD for Australia, USD for the United States), processed by Stripe, renewing automatically each month or year until cancelled.
- You can cancel anytime via the billing portal in your dashboard. Cancellation stops future renewals; your listing remains live until the end of the paid period, after which it is unpublished. Amounts already paid are non-refundable except as set out below or as required by law.
- US verification guarantee: if you pay at application and our verification of your license ultimately does not succeed, your payment is refunded in full, automatically.
- If a subscription payment fails or lapses, we may unpublish the listing until payment resumes.
- Prices may change; we'll give existing subscribers reasonable notice before a change affects their renewal.
6. Verification β what it does and doesn't mean
We carry out reasonable checks at the time of listing (and periodic re-checks in the US), but verification is a point-in-time check of public records and declared credentials. It is not a guaranteeof a provider's quality, safety, suitability, availability, or outcomes, and it does not replace your own judgement, reference checks, or confirmation of a provider's current standing.
7. Acceptable use
You must not misuse the platform: no false or misleading information, no impersonation, no scraping or harvesting of data, no attempts to circumvent security or verification, no unlawful, harassing or discriminatory conduct, and no use of the platform to market unrelated products or services.
8. Content
You retain ownership of content you submit (such as provider profiles and photos) and grant us a non-exclusive, royalty-free licence to host, display, and share it as needed to operate and promote the platform. You confirm you have the rights to everything you submit. The platform itself β including our branding, design, and software β belongs to us.
9. Liability
Nothing in these terms excludes rights that cannot be excluded under applicable law, including the Australian Consumer Law and applicable US state consumer protection laws. To the maximum extent permitted by law: the platform is provided "as is"; we are not liable for the acts, omissions, or services of any provider or family; we are not liable for indirect or consequential loss; and our total liability to you in any 12-month period is limited to the amounts you paid us in that period (or AU$100 if you haven't paid us anything).
10. Termination
You can close your account at any time by contacting us. We may suspend or terminate access for breach of these terms, legal or safety risk, or discontinuation of the service. Sections that by their nature should survive (including liability, content licence, and confidentiality of family details) survive termination.
11. Changes
We may update these terms from time to time. The date at the top reflects the current version; material changes will be notified by email or on the platform. Continuing to use the platform after a change takes effect means you accept the updated terms.
12. Governing law
These terms are governed by the laws of New South Wales, Australia, and disputes are subject to the non-exclusive jurisdiction of its courts. If you're a consumer, this doesn't deprive you of protections you're entitled to under the mandatory laws of the place you live.
